Sheriffs: New State Policy Allows Convicted Felons Evade Federal Authorities

KANKAKEE, Ill. — Illinois Sheriffs are raising alarms that a recent policy change by the Illinois Department of Corrections (IDOC) allows dangerous felons to be released back into Illinois communities. This is occurring despite valid requests by federal immigration authorities to transfer the convicted felons to a designated holding facility while the individual’s immigration case is reviewed and adjudicated.

In 2019, 223 individuals were transferred to the Jerome Combs Detention Center in Kankakee after serving time at an IDOC facility for their felony convictions. This occurred via a notification from IDOC at the request of U.S. Immigration and Customs Enforcement (ICE). Starting in January 2020, IDOC stopped notifying federal authorities and instead allowed these individuals to be released immediately from the correctional facility into Illinois communities where they had been serving their sentence.

“The public needs to know that this policy shift results in convicted felons being released back into our counties and neighborhoods without notice—despite federal authorities asking that they be transferred to another facility in the judicial system,” said Sheriff Mike Downey of Kankakee County.

More troubling to the sheriffs and law enforcement is that there is no notice or warning given to local or federal authorities when the individuals are released. “The State of Illinois is helping convicted felons get a head start on evading federal authorities who simply want to do their job,” said Christian County Sheriff Bruce Kettelkamp. “The lack of coordination is raising the stakes that a dangerous or violent altercation will occur in our communities between a recently-released felon, who knows that immigration authorities are looking for them, and any law enforcement officer. This policy undermines the rule of law, endangers our local communities and puts the lives of our first responders at risk.”

A review of the transfers completed in 2019 by the Kankakee County Sheriff Office found that the individuals requested by ICE and transferred to the correctional facility had been convicted of committing the following crimes in Illinois:

36 individuals were found guilty of sexual offenses against minors, including crimes against individuals as young as 5 years old;

11 individuals were found guilty of murder, attempted murder or intent to kill or injure;

19 individuals were found guilty of predatory criminal sexual assault; 33 individuals were found guilty of a criminal offense involving a weapon;

50 individuals were found guilty of drug offenses involving a substance other than cannabis;

and 55 individuals were found guilty of felony-level traffic offenses including aggravated DUI, having a fourth DUI or a DUI resulting in death.

The Illinois Sheriffs’ Association urges Gov. Pritzker to reconsider the policy and enable IDOC to coordinate with its partner in law enforcement and criminal justice.

Suspicious vehicle call leads to standoff and arrest of Owensville man.

On February 24, 2020, at 8:56 p.m. Gibson County Central Dispatch received a 911 report of a 2008 Chevy Silverado sitting in the middle of the roadway on County Road 550 South east of County Road 125 West. The caller reported that the vehicle was obstructing the roadway and that they were not able to pass the vehicle safely. A plate was provided by the caller and it was discovered that the vehicle was owned and possibly driven by 27-year-old Zachary Austin Garrett of Owensville, Indiana. Deputy Garrett Tuley of the Gibson County Sheriff’s Office and Indiana State Trooper Tanner Hurley arrived on scene and confirmed that Mr. Garrett was inside the vehicle and was operating the vehicle. At that point they began a high risk traffic stop to have Mr. Garrett exit the vehicle due to prior law enforcement encounters in the county that involved firearms and erratic behavior.

After being given several loud, verbal, and repetitive commands by law enforcement officers on scene Mr. Garrett failed to obey lawful commands to exit the vehicle. At that point Deputy Zach Lienemann deployed numerous pepperball rounds in and about the cab. Still Mr. Garrett refused lawful repetitive commands by law enforcement officers and remained in the vehicle. Indiana State Trooper Mike Finney then deployed his K9 unit to bring Mr. Garrett into compliance. Once Mr. Garrett exited the vehicle he was taken into custody and transported to Gibson General Hospital for medical treatment by Gibson County Ambulance Medic 4 and local law enforcement. Upon being granted medical clearance Gibson General Emergency Room he was transported to the Gibson County Jail. Upon arriving at the Gibson County Jail Mr. Garrett was charged with Resisting Law Enforcement Fleeing in a Vehicle, Intimidation of a Police Officer, and Obstruction of Traffic. He is currently being held on a $750 bond. This is an ongoing investigation.

Arresting Officer is Depu ty Garrett Tuley
Assisting Units were Captain Bryan Ellis, Sgt. Bruce Vanoven, Deputy Zach Lienemann, and Deputy Michael Rose. Also assisting were Indiana State Troopers Sgt. Kevin Brown, Mike Finney, Hunter Manning, Trooper Johnathan Lukeman, and Tanner Hurley. Also assisting in this investigation were Owensville Town Marshal Rodger Leister and Haubstadt Town Marshal Jeremy Volk.

$5 Million Psychiatric Facility To Bring 50 Jobs to Mt. Carmel

Developers are planning to build a $5 million, 24-bed acute care behavioral health facility on Mt. Carmel’s west-side. At last night’s City Council meeting, commissioners heard from Dr. Maqbool Ahmed, who along with Dr. Wasim Sajid, will build the facility under the name of Emrica, LLC, which is an Indiana registered company currently operating a similar center in Benton, Kentucky and is in the process of building another in Bardstown, Kentucky. Dr. Ahmed said plans call for building the 24,000 square foot facility on Enterprise Lane near Super 8. He outlined the economic benefits of the new facility to Mt. Carmel….

Mayor Joe Judge said negotiations to bring the treatment facility to Mt. Carmel started last October….

In the past, officials with Wabash General Hospital have expressed an urgent need for psychiatric services locally. According to Ahmed, none are available in Illinois within two hours of Mt. Carmel. Depending on licensing and building timelines, Ahmed said it’s hoped the new facility will open in late 2021. In addition to this project, Dr. Ahmed also serves as an oncologist at WGH.
