Cassandra A. Goldman, Wabash County State's Attorney, reports that Frank E. Shoultz, a 43-year old Mt. Carmel, Illinois man, was sentenced to the Illinois Department of Corrections by the Honorable Circuit Judge Christopher L. Weber in Wabash County Circuit Court.
State's Attorney Goldman advises that the Defendant was charged August 8, 2018, with Aggravated Domestic Battery, a Class 2 Felony; April 19, 2018, with Possession of Methamphetamine, a Class 3 Felony; and December 18, 2017, with Domestic Battery, a Class 4 Felony. Mr. Shoultz was sentenced to 6 years in the Illinois Department of Corrections, to be followed by four years of mandatory supervised release (parole). The Defendant is required to serve 85% of this sentence.
FACTS AND CIRCUMSTANCES OF OFFENSE:
2018-CF-79:
That on the 6th day of August, 2018, in Wabash County, Illinois, the Defendant, FRANK E. SHOULTZ, committed the offense of AGGRAVATED DOMESTIC BATTERY, in that said Defendant knowingly without legal justification caused bodily harm to XXXXXX, with whom the Defendant is in a dating relationship, in that he strangled XXXXXX by intentionally impeding her normal breathing or circulation of blood by applying pressure on her throat, in violation of 720 ILCS 5/12-3.3(a-5). A CLASS 2 FELONY
2018-CF-43:
That on the 18th day of April, 2018, in Wabash County, Illinois the Defendant, FRANK E. SHOULTZ, committed the offense of POSSESSION OF METHAMPHETAMINE, in that said Defendant knowingly and unlawfully had in his possession less than 5 grams of a substance containing methamphetamine, other than as authorized in the Methamphetamine Control and Community Protection Act, in violation of 720 ILCS 646/60(a). A CLASS 3 FELONY
2017-CF-195:
That on the 17th day of December, 2017, in Wabash County, Illinois, the Defendant, FRANK E. SHOULTZ, committed the offense of DOMESTIC BATTERY, in that said Defendant, without legal justification, knowingly made physical contact of an insulting nature to XXXXX, with whom the Defendant has a dating relationship with, in that said Defendant struck XXXXX in the head; and, at the time of this offense, Defendant had previously been convicted of a violation of 720 ILCS 5/12-3.2 in Wabash County, Illinois 2017-CM-45 on September 5, 2017, in violation of 720 ILCS 5/12-3.2(a)(2).
