Executive Order Carve Out in Illinois for Church Services

There is a change coming for the state’s stay at home order. Democrat Governor JB Pritzker has modified his executive order to allow for the “free exercise of religion”. The order still requires the exercise of religion to observe social distancing and limits gatherings to 10 people.

The changes come after a pastor in the town of Lena sued the Governor for infringing on his and his congregations first amendment rights. Pritzker says he hopes members of churches make a responsible decision and stay away from large gatherings where asymptomatic people could spread COIVD-19.

Church has become an essential service in Illinois.

Bailey Statement On Vacating Temporary Restraining Order

Louisville, IL. – State Representative Darren Bailey said today he asked the Appellate Court to voluntarily vacate his restraining order against Governor J.B. Pritzker’s Executive Order that shut down most of Illinois and ordered citizens to ‘stay at home.’  However, his efforts seeking the Court’s determination that the Governor exceeded his authority will not end but will only get stronger.

 “In light of new documentation recently uncovered, which the Governor’s office and the Department of Public Health failed to provide as required by Illinois law, we feel it is in the best interest of the people of the State of Illinois to voluntarily ask the Appellate Court to vacate the temporary restraining order.  I will then file ask to file an amended complaint in the circuit court alleging the newly discovered facts and issues.

“This new information offers a more complete picture and brings to light additional problems in regard to the procedural and substantive shortcomings of the Governor’s office and the Board of Health’s safeguarding of the civil rights of the citizens of the state.  This will strengthen our efforts to ensure the liberty of all Illinoisans.”

Bailey said if the State Supreme Court is going to hear this case, he wants the Justices to have all of the information available because their important decision will impact the lives of millions of citizens.

MCPD ISSUES STATEMENT ON PPE ENFORCEMENT

The Mt. Carmel Police Department has received phone calls concerning the enforcement of wearing personal protective equipment (PPE) in public.  The Mt. Carmel Police Department is NOT on “patrol” looking for violations.  The Mt. Carmel Police Department would like to remind individuals that local businesses can refuse service if you are not following the PPE guidelines.  If police respond to an establishment due to a disorderly customer or a person refusing to leave the premises, the person is subject to arrest. 

We would just like for individuals to use common sense during these times, and please be mindful of the rules while visiting our local stores.  We would also like to remind you to be kind to those who are serving you.

Xenia Man Seriously Injured In Single Vehicle Crash

ISP TRAFFIC CRASH ALERT

The Following Preliminary Information is Being Released by Illinois State Police

District 12

 WHAT:                      Single Vehicle Injury Traffic Crash

WHERE:                   Cherry Bark Lane at Hanging Rock Road, Clay County

WHEN:                      April 30, 2020 at 4:11 a.m.

VEHICLES:              Unit 1- 2002 Silver Chevrolet Express Van

DRIVERS:                Unit 1- Damien Sons, 25 year old male from Xenia, IL – transported by helicopter to an area hospital with life threatening injuries

PRELIMINARY:       A preliminary investigation indicates the following occurred:  Unit 1 was traveling west on Cherry Bark Lane near Hanging Rock Road in Clay County.  The driver of Unit 1 ran off the roadway to the left and struck a tree.  Unit 1 driver was transported by helicopter to an area hospital with life threatening injuries.  This crash is still under investigation.

 

CHARGES:                   Pending investigation

 

All subjects are presumed innocent until proven guilty in a court of law.

ILLINOIS STATE POLICE OBTAIN MURDER CHARGES; ARREST MADE IN INDIANA

Beecher City, IL – On Wednesday, April 29, 2020, the body of Kimberly A. Mattingly, 29, was discovered in rural Beecher City, IL. As the result of an investigation by the Illinois State Police (ISP) Division of Criminal Investigation (DCI), a warrant for the arrest of Christopher E. Glass, 36, of Mason, IL was obtained through the Effingham County State’s Attorney’s Office for two counts of First Degree Murder, Concealment of Homicidal Death and a parole violation warrant from the Illinois Department of Corrections (IDOC). Glass was taken into custody by the Indiana State Police and Terra Haute Police Department and is in their custody pending extradition to Illinois.  Glass’ bond has been set at $5 million dollars, 10% applies.  Additionally, Aaron M. Kaiser, 37, of Beecher City, IL was arrested and charged with Concealment of Homicidal Death. Kaiser is being held in the Effingham County Jail pending a bond hearing.  If convicted, the First Degree Murder sentencing range is between 20-60 years, up to life in the IDOC. If convicted of concealment of a homicidal death, the sentencing range is up to 2-5 years in the IDOC.

The ISP DCI was assisted by multiple law enforcement agencies during the course of this investigation including, the Shelby County Sheriff’s Office, Edgar County Sheriff’s Office, Effingham County Sheriff’s Office, Paris Police Department, Edgar County State’s Attorney’s Office, Indiana State Police and Terra Haute Police Department.

This matter is an ongoing investigation by the Effingham County Coroner’s Officer, Effingham County State’s Attorney’s Office and the Illinois State Police. No additional information is being released at this time.

ATTORNEY GENERAL ISSUES STATEMENT ON OPENING BRIEF FILED IN 5TH DISTRICT APPELLATE COURT

Chicago — Attorney General Kwame Raoul issued the following statement upon filing a petition and opening brief in Bailey v. Pritzker. The brief was filed today in the 5th District Appellate Court. 

“Earlier this week, the 4th Judicial Circuit Court held that the threat to public safety that is posed by COVID-19 is outweighed by Mr. Bailey’s interest in not complying with the Governor’s stay-at-home order. 

“We continue to assert that Mr. Bailey has failed to articulate the irreparable harm he is personally experiencing or how that harm outweighs the unprecedented threat to public health and safety. Using the authority of his office granted by the Illinois Constitution and the Illinois General Assembly, Gov. Pritzker has implemented emergency measures that have saved lives during a crisis that has cost Illinois so much. In fighting the threat to public safety, Gov. Pritzker has not exceeded his authority under the law by taking emergency action for longer than 30 days. 

“There is no question that the COVID-19 pandemic has forever changed our state, and government must balance the critical need to save lives with the economic hardships being felt by residents throughout Illinois. Governors have historically renewed disaster declarations to meet the challenges of disasters that last longer than 30 days without objection, and a pandemic should be no different.

“I am asking the appellate court to address this mistaken circuit court decision now. In addition, I believe that it is paramount for the Illinois Supreme Court to take up this matter immediately because continued uncertainty surrounding this question will lead to additional actions — as we have seen today — that threaten the Governor's ability to save lives.”
